These Terms of Service apply when you access or purchase from thecollectorsguild.com.au.

The website is operated by WILSON, AARON, ABN 14 429 909 591, trading as The Collector’s Guild.

By using the website or placing an order, you agree to these terms.

Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law.

Eligibility

You must be legally capable of entering into a purchase contract. Customers under 18 should use the website and make purchases only with the involvement and permission of a parent or guardian.

Products and descriptions

We take reasonable care to describe products accurately and display representative photographs.

Colours and appearance can vary between screens. Minor packaging changes may also occur.

Raw trading cards are not professionally graded unless expressly stated. A condition description does not guarantee a future grade from a professional grading company.

Sealed trading-card products contain randomly distributed contents determined by the manufacturer. We do not guarantee pull rates, card values or particular cards unless expressly stated.

Mystery Packs contain randomly allocated products and any guaranteed contents described on the relevant product page. Published chase odds apply to the entire stated production batch and do not guarantee a chase product within any individual order or smaller sequence of orders.

Orders

Submitting an order is an offer to purchase. An order is accepted when we confirm that it has been processed for fulfilment.

Products may be sold through multiple sales channels, including Shopify and eBay. Although inventory is synchronised, an item may occasionally become unavailable because of simultaneous orders, an inventory error, damage or another issue.

If we cannot supply an ordered product, we will contact you and provide a refund or another agreed solution. We will not substitute a materially different product without your agreement.

We may decline or cancel orders affected by suspected fraud, payment failure, pricing errors, inventory errors, misuse of promotions or unlawful activity. If payment has been taken for a cancelled order, it will be refunded.

Prices and payment

Prices are displayed in Australian dollars and include GST where applicable.

Shipping charges are displayed at checkout before payment. You are responsible for providing accurate billing, payment and delivery information.

We may correct genuine pricing or product-information errors. If an error affects an order you have placed, we will contact you before proceeding or provide a refund.

Shipping, returns and refunds

Our Shipping Policy and Refund and Returns Policy form part of these terms.

Estimated dispatch and delivery periods are not guarantees. We remain responsible for providing remedies required under the Australian Consumer Law.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

Notify us promptly if you believe an account has been accessed without authorisation.

Acceptable use

You must not:

  • Use the website for unlawful or fraudulent purposes

  • Interfere with the website’s operation or security

  • Attempt to access information or systems without authorisation

  • Submit malicious code or automated requests that disrupt the website

  • Use false information to obtain products, discounts or refunds

  • Reproduce or commercially exploit website content without permission

Intellectual property

The Collector’s Guild branding, website text, graphics and original content belong to us or are used with permission.

References to Pokémon and other brands, products and trademarks belong to their respective owners. The Collector’s Guild is an independent retailer and is not affiliated with or endorsed by The Pokémon Company, Nintendo, Game Freak or Creatures Inc.

Third-party services

The website may use or link to third-party services, including Shopify, payment providers, eBay, Australia Post and social-media platforms. Those services may have separate terms and privacy policies.

Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable.

This limitation does not apply where liability cannot legally be excluded or limited, including rights and remedies available under the Australian Consumer Law.

Changes

We may update the website, products and these terms from time to time. Changes apply from the date the updated terms are published and do not retrospectively remove rights attached to an existing order.

Governing law

These terms are governed by the laws of Queensland, Australia. You submit to the courts and tribunals that have jurisdiction in Queensland, without limiting any rights you may have under applicable consumer law.
